I posted the following comment in response to a comment I made on the Air Talk community blog at KPCC. The topic was the proposal to allow people who $500,000 in the U.S. which could include a house and other real estate property (currently not included in the Immigrant and Treaty Investor provisions) be allowed a 3 year temporary “no work” visa to live in the U.S. This is what I wrote:
- I’m an immigration lawyer and there has been for a “Treaty Trader and Treaty Investor Visa (E-1 and E-2) for many years now. However, since the person must be “managing” the investment residential property doesn’t qualify. Also, the U.S. does not have treaties with all countries (e.g. such as India and China) so this would just be an extension of the law to a wider class of investors. Investment in the U.S. – no matter what country the investor is from – is an investment in our future.

I already very much resent the CURRENT scheme allowing wealthy folks to “jump the line” in immigration. This BAD IDEA just takes the mask off of yet another means of special treatment for rich folks with special influence to buy favors and drown out–and ignore–the voices of the other 99 percent.

I agree 100% that the “voices of the other 99%” of people who want to come legally to the U.S. is being ignored. What the country needs is comprehensive immigration reform – especially a “Dream Act” for people who came illegally to the U.S. when they were very young and although are “American” in all other respects cant even get a social security card (or drivers license).However, it appears that nothing has happened or will happen to change our nation’s laws to make a fairer immigration law due to political deadlock. This proposal to give temporary “no work” visas to foreign investors doesn’t really change the law that much — it only allows investors to make qualifying investments in residences as opposed to businesses and opens it up to people from countries that don’t have treaties with the U.S. for investors. Personally, I doubt that the ability to get a 3 year temporary visa will make that big a difference to someone who has an extra $500,000 to invest in the U.S. or buy a house. However, I think it would start the ball rolling to rethink U.S. immigration policy and focus on some of the many benefits that immigrants bring to this country – not only outside financial capital but diversity, a strong work ethic and a sincere appreciation of nation’s strengths that many of our citizens lack.
